Denver Finalizes Local NMHA Licensing Ordinance

The Denver City Counsel recently passed, and Mayor Johnson signed, a new law creating regulations for NMHA businesses in Denver. The new law adopts the state of Colorado’s rules for natural medicine and establishes a city license for healing centers run by non-clinical facilitators (healing centers run by clinical facilitators do not need a local license). Cultivating, manufacturing and testing facilities do not need a city license. Healing centers are not permitted within 1,000 feet of child care centers and schools. There are no new zoning districts in Denver for NMHA businesses, so your business would need to be consistent with existing uses allowed in various zone districts (so medical or office uses for healing centers, plant husbandry for cultivation, and industrial zoning for manufacturing facilities). State Enforcement Against Decrim Projects: April 17, 2025 Webinar on Decriminalization Provisions of NMHA

The state of Colorado has created a new process to complain about businesses advertising or selling natural medicines illegally. See here. The first consumer alert has been issues about an allegedly illegal/unregulated projects in CO. See here. This is one of the hottest topics in Colorado – what kind of work can be done in the decriminalized environment of Colorado’s NMHA? Can licensed facilitators also do work in the unregulated area? What are the limits of being paid for harm reduction services while giving away natural medicines? What enforcement actions have the state taken either under criminal and civil law?
