How to Navigate FDA Labeling Requirements for CBD and Hemp Products
One question that we get a lot about CBD and hemp is how to navigate FDA labeling requirements. This is a confusing topic because the FDA hasn’t provided any clear guidance about what is allowed. They’ve only posted some opinions about what is not allowed. The one thing to really avoid in this area is making health claims about your product. You can’t say that CBD or your hemp oil product cures any particular condition. This is one area where we have seen the FDA take decisive action against CBD companies by sending them warning letters. The FDA has not otherwise tried to shut down a CBD industry although CBD and hemp still are not clearly defined for purposes of FDA enforcement actions. These are issues that we tackle here every day and we’d be happy to talk to you about how your products fit into the regulatory scheme.
